1. Acceptance of Terms

By accessing or using AlgoEngineer's website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

These Terms constitute a legally binding agreement between you and AlgoEngineer ("we," "us," or "our"), a company registered in the State of Texas, United States.

Please read these Terms carefully, including the binding arbitration clause and class action waiver in Section 15, which affect your legal rights.

2. Eligibility

You must be at least 13 years of age to create an account and use our services. If you are between 13 and 17 years old, you may use our services only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to make purchases, enter into payment agreements, or enroll in paid courses.

By using our services, you represent and warrant that you meet these age requirements.

3. User Accounts

3.1 Account Creation

To enroll in courses, you must create an account by providing:

  • Full name (required)
  • Valid email address (required)
  • Phone number, LinkedIn profile, GitHub profile (optional)

You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access at contact@algoengineer.com.

3.3 Account Restrictions

Each account is for individual use only. You may not share your account credentials with others. Account sharing may result in immediate suspension without refund.

4. Course Access and Enrollment

4.1 Platform Lifetime Access

Upon successful payment, you receive access to course materials for as long as AlgoEngineer continues to operate the platform ("Platform Lifetime Access"). This includes:

  • Recorded lecture videos
  • Problem bank and solutions
  • Course handouts and resources
  • Access to the student dashboard

"Platform Lifetime Access" means access continues for as long as AlgoEngineer maintains and operates the platform. If AlgoEngineer ceases operations or discontinues the platform, we will provide at least 90 days' notice and make reasonable efforts to allow you to download your course materials and personal data before access ends.

4.2 Live Cohort Sessions

Live instructor-led sessions are available only during your enrolled cohort period. Once the cohort ends, you retain access to all recorded sessions but cannot attend future live classes without enrolling in a new cohort.

4.3 Course Modifications

We reserve the right to update course content, curriculum, and instructors to maintain quality and relevance. Any significant changes will be communicated to enrolled students via email. Updates do not entitle you to a refund.

5. Payment Terms

5.1 One-Time Payment

AlgoEngineer operates on a one-time payment model. There are no recurring subscription fees. You pay once and receive Platform Lifetime Access as defined in Section 4.1.

5.2 Pricing

All prices are displayed in USD on our pricing page. Prices are subject to change, but any price change will not affect existing enrollments. Promotional pricing and discounts are available at our discretion, are time-limited, and may be withdrawn at any time.

5.3 Payment Processing

Payments are processed securely through Helcim, a PCI DSS Level 1 certified payment processor. Your card information is entered directly into Helcim's secure iframe and is never transmitted to or stored on our servers. We retain only the last four digits of your card, the card brand, and the transaction record for our accounting records.

5.4 Failed Payments

If your payment fails, you will receive an email notification. You have 48 hours to resolve the payment issue. If the payment is not resolved within 48 hours, your enrollment will not be activated and you will need to re-initiate the enrollment process.

5.5 Chargebacks

If you dispute a charge with your bank or credit card company (a "chargeback") instead of requesting a refund through our refund process described in Section 6, we reserve the right to suspend your account immediately pending resolution of the dispute. Fraudulent chargebacks (disputing a charge while continuing to use the course) may result in permanent account termination, collection action for the amount owed, and reporting to fraud prevention services.

6. Refund Policy

We offer a 7-day money-back guarantee from your cohort start date (NOT your enrollment date). For self-paced courses without a cohort schedule, the 7-day window begins on your purchase date. For full details, see our Refund Policy.

7. Prohibited Conduct

You agree NOT to:

  • Share course materials publicly or with non-enrolled individuals, including uploading to file-sharing sites, forums, or social media
  • Record or redistribute live classes, instructor videos, or any copyrighted course content
  • Use automated tools (bots, scrapers, crawlers) to access, download, or copy course content
  • Submit plagiarized code, cheat on assessments, or misrepresent your work during mock interviews
  • Harass, threaten, or abuse instructors, teaching assistants, or other students
  • Attempt to circumvent access controls, security measures, or rate limits
  • Submit malicious code designed to damage, disrupt, or gain unauthorized access to our systems through the code execution environment
  • Violate any applicable laws or regulations while using our platform

Violations may result in immediate account suspension or termination without refund. We reserve the right to report violations to law enforcement if applicable.

8. Intellectual Property

8.1 AlgoEngineer Ownership

All course materials, including videos, problem sets, code solutions, curriculum, written content, graphics, and platform software, are the intellectual property of AlgoEngineer and are protected by United States and international copyright, trademark, and other intellectual property laws.

8.2 Limited License

Upon enrollment, you are granted a non-transferable, non-exclusive, revocable license to access and use course materials for your personal, non-commercial educational use only. This license does not include the right to reproduce, distribute, publicly display, create derivative works from, or commercially exploit any course materials.

8.3 Student Submissions

You retain ownership of the code and content you submit. By submitting code or other content to our platform, you grant AlgoEngineer a non-exclusive, worldwide, royalty-free license to store, process, evaluate, and display your submissions for the purposes of grading, feedback, analytics, and platform improvement. We will not publicly share your submissions with your name attached without your consent.

9. Disclaimers

9.1 No Job Guarantee

AlgoEngineer provides educational services only. We do not guarantee job placement, interview success, salary outcomes, or career advancement. Your success depends on your individual effort, skills, prior experience, and market conditions. Any testimonials, case studies, or success stories shared on our platform represent individual results and are not guarantees of future outcomes.

9.2 Third-Party Services

We rely on third-party services (Zoom, YouTube, Helcim, AWS) to deliver parts of our platform. We are not responsible for outages, service interruptions, data breaches, or policy changes by these providers. We will make reasonable efforts to minimize disruption and notify you of any material impact.

9.3 "As Is" Provision

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AlgoEngineer and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Failed job interviews, employment outcomes, or career decisions
  • Damages arising from third-party service failures, including but not limited to Zoom outages, AWS downtime, or Helcim processing errors
  • Any unauthorized access to or alteration of your data or transmissions

Our total aggregate liability for all claims arising out of or relating to these Terms or your use of our services shall not exceed the total amount you paid to AlgoEngineer in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless AlgoEngineer, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:

  • Your violation of these Terms
  • Your misuse of course materials or the platform
  • Your infringement of any third party's intellectual property rights
  • Any content you submit to the platform that violates applicable laws or third-party rights

12. Force Majeure

AlgoEngineer shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecommunications failures, power outages, third-party service provider outages (Zoom, AWS, Helcim), cyberattacks, or labor disputes.

In the event of a force majeure affecting live cohort sessions, we will make reasonable efforts to reschedule affected sessions or provide alternative access (such as recorded sessions) as soon as practicable.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, store, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.

14. Termination

14.1 By You

You may request account deletion at any time by contacting contact@algoengineer.com. Account deletion does not entitle you to a refund if the 7-day refund period has expired. Certain data may be retained as described in our Privacy Policy to comply with legal obligations.

14.2 By Us

We reserve the right to suspend or terminate your account, with or without notice, for violations of these Terms, fraudulent activity, abusive behavior, or if required by law. Upon termination for cause, you forfeit all access to course materials and are not entitled to a refund.

14.3 Effect of Termination

Upon termination, Sections 8 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), 15 (Dispute Resolution), and 16 (Governing Law) shall survive and remain in full force and effect.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing any formal proceeding, you agree to contact us at contact@algoengineer.com and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through informal communication.

15.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Texas, and the arbitrator's decision shall be final and binding.

For claims under $10,000, arbitration will be conducted by written submissions only, unless you or we request an in-person hearing. AlgoEngineer will pay all AAA filing and arbitrator fees for claims under $10,000, provided the claim is not frivolous.

15.3 Class Action Waiver

You agree that any arbitration or court proceeding shall be conducted only on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against AlgoEngineer.

15.4 Exceptions

Notwithstanding the above, either party may: (a) bring an individual action in small claims court for claims within that court's jurisdiction; or (b) seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15.5 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to contact@algoengineer.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved under Section 16.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. If the arbitration provisions in Section 15 do not apply (because you opted out or the claim falls within an exception), any legal action shall be brought exclusively in the state or federal courts located in Collin County, Texas. You consent to the personal jurisdiction of these courts.

17. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect and update the "Last Updated" date. Your continued use of our services after the effective date of the changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our services.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and AlgoEngineer regarding your use of our services and supersede all prior agreements, understandings, and communications, whether written or oral.
